Register of Variations to Development Standards
Development standards are provisions under the Local Environmental Plan (LEP) that provide numerical or non–numerical limitations on development.
In the instance that a development application seeks to vary a development standard, it must be supported by a written application. This application is to demonstrate that strict compliance with the development standard would be unreasonable or unnecessary and there are sufficient environmental planning grounds to justify contravening the development standard.
Council is required to maintain an accurate register of instances when a development application is determined with a development standard having been varied under Clause 4.6 of the LEP.
The register contains any development applications that have been determined with a variation to a development standard.
